Advocates push for NEPA to be upheld when BLM snubs public comment

Reno, NV (Jan. 26, 2015)—Protect Mustangs and Friends of Animals (FoA) have filed a lawsuit against the Bureau of Land Management (BLM) to stop the round-up and permanent removal of 200 wild horses in the Pine Nut Herd Management Area (HMA) and the round-up of another 132 wild horses so that an estimated 66 mares would be forcibly drugged with the pesticide known as PZP for fertility control. In addition, the groups plan to file a temporary restraining order—asking the judge for an emergency ruling so that the BLM can’t round up any horses or administer PZP until the court has time to hear FoA’s and Protect Mustangs’ case. The roundup is expected to last for 10 days and is slated for late January/early February.

“The BLM abruptly made a decision in December of 2014 to round-up, permanently remove and forcibly administer fertility control drugs on our wild horses. This decision has long-lasting implications for wild horses,” said Jenni Barnes, attorney for FoA’s wildlife law program. “BLM violated the law by excluding the public from this decision and completely failing to consider its impacts. FoA and Protect Mustangs have filed this lawsuit to ensure that BLM does not destroy Nevada’s last remaining wild horses.”

“The American public is outraged elected officials aren’t doing anything to stop cruel roundups and sterilization experiments on our native wild horses,” said Anne Novak, executive director of Protect Mustangs. “It’s disgusting and shameful. Risky drugs like PZP and other forms of sterilization are a sham at this point because there aren’t any ‘excess’ wild horses on millions of acres of public land.”

“When wild horses don’t seem useful to the BLM, they’re resented. Rounded up. Sterilized. Killed or otherwise displaced,”said Priscilla Feral, FoA’s president. “In contrast, cows and sheep owned by large corporations and hobby ranchers are seen as having a dollar value, so ranchers are relieved from having to compete over water and grasslands with horses. Since horses are not hamburgers, Nevada and the BLM want them gone. People don’t want this madness anymore.”

The lawsuit states that the defendants did not prepare an Environmental Assessment for the proposed roundup and instead relied on the 2010 environmental assessment for the Clan Alpine, Pilot Mountain and Pine Nut HMA Gather Plan, which does not take into consideration science that shows the negative side effects associated with PZP. Furthermore, the BLM did not solicit public comments. In fact, FoA employees traveled to Nevada on Jan. 22 to participate in a BLM public meeting regarding the Carson City Resource Management Plan, which includes the Pine Nut HMA, but the BLM denied the public the ability to comment. When Edita Birnkrant, FoA’s campaigns director, got up and spoke at the microphone anyways, she was silenced—BLM shut off the microphone and ejected her from the meeting, just like BLM removes wild horses from public land.

“I was infuriated that the BLM dared to hold a ‘public’ meeting yet forbid the public from speaking,” said Edita Birnkrant, FoA’s campaign director. “BLM employees specifically said there would be no discussion of the Pine Nut roundup during the intro to the meeting. After the intro, I took over the microphone to call out the sham of a BLM public meeting that shut out the public. I said that FoA was there to oppose the BLM’s extinction plan for wild horses in Nevada.”

FoA and Protect Mustangs oppose all roundups of wild horses and the use of PZP, which destroy family structure within the herds, and believe the Appropriate Management Levels set for the Herd Management Areas in all states are too low, outdated and do not accurately reflect the number of wild horses that are needed to maintain genetic viability to prevent extinction and to create a thriving ecological balance.

The groups are adamant the BLM looks beyond data about PZP provided by the Humane Society of the United States, which has a vested interest in PZP as it is the registrant of the pesticide, and Jay Kirkpatrick, the director of the Science and Conservation Center, which produces the active ingredient in PZP. FoA believes the public needs to know there is a conflict of interest when it comes to PZP and it questions the motives of an animal charity pushing a harmful pesticide on wildlife rather than embracing holistic ways to manage public lands.

Novak pointed out that according to the National Academy of Sciences’ 2013 report, there is “no evidence” of overpopulation.

Ranchers scapegoat wild horses because they don’t want to share the public land they lease to graze their livestock. So they bully the Bureau of Land Management to remove wild horses. In Beaver and Iron County, Utah, where wild horses are scapegoated, data shows cows and sheep outnumber wild horses 10.6:1; in Oregon it’s 33:1. And prior to a massive roundup in Wyoming last summer, there were 356,222 cattle, 45,206 sheep, and only 1,912 wild horses. It seems that it’s easier for the BLM to accommodate ranchers and manage wild horses to extinction, than to consider holistic ways to manage our public lands.

“Wild horses need to be protected in Nevada,” said plaintiff Craig Downer, a wildlife ecologist who has studied the Pine Nut herd for decades and author of The Wild Horse Conspiracy. “They restore the ecosystem as a deeply rooted native in North America with a unique niche that helps the other species thrive.”

In his book, Downer, also the director of ecology and conservation for Protect Mustangs, advocates for reserve design , which involves utilizing natural and/or artificial barriers, natural predators, as well as community-involving buffer zones as a better way for BLM to manage public lands. Once available habitat is filled, wild horses, as climax species, would limit their own population as density-dependent controls are triggered.

“The bottom line is the BLM is ignoring the public’s right to be heard about a heinous roundup paid for with tax dollars on public land,” explains Novak. “And that’s just unAmerican.”

  1. Thank you Protect Mustangs for opposing the BLM’s “management to extinction ” plan for our wild horses which consists in continuing both roundups and use of sterilizing PZP. Wild horses are not overpopulating and therefore do not need to be removed or sterilized by the BLM. They need to be returned from BLM holding facilities to their native ranges where they are supposed to be protected by federal law from BLM harassment on behalf of corporate profiteers who are turning our public lands into Wasteland through overgrazing cattle, fracking and mining.

  2. The Dept of Interior & BLM need to stop the endless money pit of the welfare ranchers. They don’t pay per MONTH an amount equal to what it costs to hold a horse per day. What they pay per 6 months about equals what it cost for a ho0rse for 1 DAY. They are wasting billions of taxpayers $$ and the American public does not want to be in the ranching business, subsidizing their ranches so they can get rich at our expense. The really gross abuse is the loss of our wild horses & burros on our public lands where they could be free of cost running free, and loss of life. Time to stop the roundups, stop drugging our wild horses and look at the numbers. Millions of privately owned livestock to less the 30 thousand wild horses. You are not fooling the public with which one is doing the damage to our lands. Time to find out why DoI and BLM are so intent on removing our horses. Time to look at the motivator, it isn’t protecting our lands or they would reduce the privately owned herd sizes. Next thing is money, who is getting rich off the loss of freedom and life of the wild horses. Time to start looking deeper.

  3. The wild horses are already reduced significantly, to the point, if round ups and the implementation of this PZP program continues they will become extinct. The waste of tax payers money on this program is deplorable. The BLM has not listened to scientific evidence which concludes that the cattle that graze public lands are doing the harm, and yet the BLM will not enforce protection of the leased land or enforce collection of delinquent money owed from Ranchers for the use of the land. The BLM has not put any effort towards protecting the wild horses and protecting the public lands. Public lands are sold or leased to companies for profit. Like the ranchers, fracking, mining, etc. destroys the land not only for the wild horses, but for all wild life. When water ways are polluted and global warming issues are ignored. Out of the billions of acres, why can’t the BLM designate more areas for the horses and other wild life to exist? Wolves, Bison, Elk, are also in danger. I would like to see the BLM make a comprehensive map of all leases and public land use and justify any more action against wild horses and other wild life before they proceed with any more round ups and subject our lands to any more destruction at the hands of for profit business.

I am so grateful to Protect Mustangs and to Friends of Animals for having the guts to take on the corrupted BLM and the Welfare Ranchers who had the audacity to “moo” at FofA during the PUBLIC BLM meeting. I will be donating to both organizations as often and as much as I can and I will not ever again donate to any “environmental” organization that supports the use of PZP, and apparently there are several. Although it is only recently that the dangers and risks involved with giving PZP to OUR wild mares have surfaced, I have been adamantly against any form of birth control on our Wild Horses, mares or stallions, because OUR Wild Horses and Burros are extremely underpopulated – not overpopulated. It is simple math. Several decades ago there were two million Wild Horses and Burros on our public lands. When the 1971 legislation was unanimously passed, it was done because the killers, both ranchers and dog food companies, had reduced their numbers to 25,000. Today, our horse advocates who are on the ranges estimate that there are only 15,000 WH&Bs left on the range. Yes, it is simple math and add that to the disclosure of the pesticide content of PZP, the BLM is blatantly and without transparency in the process of killing off all of OUR precious Wild Horses and Burros. I reiterate. We are a growing movement who now has an active leadership in these two organizations which I will do my utmost to support and I strongly urge you to do the same.

  5. Thanks to Protect Mustangs and FOA there seems to be a light shining in the tunnel of darkness that is the BLM Genocide of Mustangs. I for one support these group efforts and am proud to know that there are people out there working to make a difference. Keep educating the public everyone who supports this movement, even though we aren’t there on the front lines we as supporters can do our part by educating the public when and where we can. The BLM should be ashamed of themselves for this genocide they are conducting on American History Icons were it not for the Wild ones so many things would not have been possible, colonization of the west would have been much harder, pony express would not have been able to carry mail and messages across the US and so much more. Grow a spine BLM and stop your massacre.

You have for to long ignored the plea’s of horse advocates and now your ignoring the science and environmentalist communities as well. PZP will destroy the wild horse herds as we know them it is not a viable alternative to letting the horses free range and the elements and natural circumstances will take care of thinning the herds. I have one more thing to say about all of this, any organization or group that professes to be for fair treatment of animals in general and wild horses in particular can not be for PZP!!! If you truly love the animals fight for them with every bit of power you have because when they are gone there will be no more!!!! I don’t mean pet wild horses I mean free roaming on their land wild horses!!

And how does this country repay the wild horses. For all the hard work. Helping to form this land. It is by killing them off. Taking away their freedom. Who would give their horses pzp? It’s a pesticide used for killing insects!!! Is not for birth control!     PZP darting will never stop roundups.
    It’s now time for the taxpayers , that have no hidden agendas ( grants/donations) or ulterior motives (hidden BLM sponsors) to speak out and demand freedom from experimentation for what’s left of our nation’s equine heroes. Our Wild horses are in danger of extinction, and absolutely do NOT need to be removed or sterilized by the BLM. They need to be removed from the horrid holding facilities, and returned to the freedom they deserve as Icons of the West. I want my ancestors to be able to see a Mustang in all his splendor and awesomeness running free like I have. This is our heritage the BLM is taking away! How dare they! I REFUSE to stand for it any longer!

  13. I am happy that this lawsuit has been filed to defend the rights to land, habitat, and natural liberty of the special Pine Nut wild horses, a herd I grew up visiting. They are my extended family and such an important quality of life. They have so much to contribute. Hope more of you can read my book in which I describe this wonderful herd and ecosystem. We can win, but we must persist, for we have the greater truth and justice on our side, which is to say on the side of the wild horses in the wild!

  14. I, Too, greatly appreciate this action by Protect Mustangs and Friends of Animals. The Pine Nut HMA is home t one of the most unique wild horse populations on public land. They are characteristically dimunitive. Why repeat a capture that occurred jjust 4 years ago when67 were taken, 46 mares were PZP’d for a total of 118 returned to the range. Suddenly in 3 years, the population incresed to 332? Preposterous! The plan this year. was to capture 330 horses, remove 200 and PZP all fillies (1 year an older) and mares.

    Why? The stallions know the mares are not settling and will contnue to respond to the mares heat cycles and may attempt to breed with fillies in their desperate attempt to propogate the species. The fighting and injuries which shall occur are horrendous to consider.

    This Pine Nut capture is uncalled for. It is obvious ranchers have been releasing their horses. You cannt interbred the Pine Nut horses with other horses due to the unique characteristics of the horses on this HMA. And finally, BLM is not apprpriately responding to the public’s demand to be included in rational decisions for proper management. Instead, the demands are being met of a small minority of “permitted users” for more than their fair share of the landscape.

    This capture and all the others on the thrown together “gather” schedue MUST not proceed until these discrepancies in allegiances and best use of resources is resolved.

  17. Wild horses and burros are supposed to be protected as a principal component of OUR Public Lands. They are supposed to be protected from capture, harassment, branding and death, all of which the blm inflicts upon them. The holding facilities are full and the Public ranges are becoming devoid of their presence. They are not commodities or guinea pigs, they are living symbols of Freedom and the pioneer spirit. It is clear that the blm and their criminal contractors are in the horse commodity business using our tax dollars to steal them from our public lands and warehouse them; then they make money off the back end selling them. Prisons are even in on the money making action also profiting from our iconic wild horses. It is also clear the blm/doi have no intention of protecting them from extinction in the wild. Blm has never abided by its mandate to protect America’s wild horses and burros and this responsibility is taken very seriously by American citizens. The blm should be investigated, prosecuted, and held accountable for its crimes against the taxpayers and wild equines which belong to all Americans.

Money can be made in many ways, to make them on behalf of Nature, by killing and mistreating it, is one of Mans catastrophes that we truly need to stop now, if we want the Earth to survive! This is no joke! It is real! Nature needs a break – give it to it! Leave it alone to lick its wounds and recover, so we deliver a healthy Earth to generations to come! And there are other things to do for a living than mistreating nature!   23. I am so glad we have taken this action. I felt all along that a lawsuit against the BLM was the only way. Well the BLM finally shot themselves in the foot at the meeting saying it was a public meeting then denying the publlic to speak. It certainly showed they were afraid to have the truth come out. They know they are guilty as sin when they profess to protect our wild horses. They hate them. What True American can treat these icons of the west with PZP?How can they round up these beautiful animals with helicopters maiming so many by the fast chase. Little foals falling with broken legs. Horses falling and dragged by one leg and thrown into the pens to weak to get up. The BLM laughing and joking all the while. This is a sick organization and nno longer of use for ptotecting OUR WILD HORSES. They never were. In America you expect justice for such actions.

    PZP is just another word for the death penalty for our wild horses. We owe them so much. They helped settle the West. Ranchers used them for cow poniess and rounded theem up selling them. They had the endurance to arry our mail for the Pony Express.
    This is our big chance. Please do your part or there will be no wild horses. No beautiful herds to run with tails and manes lifted by the wind as they run wild and free as they give you the show of a lifetime.

  24. I am grateful to Protect Mustangs and Friends of Animals for the legal action they have put into motion against the Bureau of Land Management (BLM). For decades now the BLM has rode ’em, rounded them up, and removed the American wild horses from their rightful, federally protected rangeland. So much so, currently 50K horses are held in stockyards, herds destroyed and families forever split up all at the expense of the American tax payers. The blm recently denied the public the right to comment in Nevada, under the jurisdiction of the law they are not suppose to do that. Furthermore, vaccination of the pesticide PZP is known to sterile animals after continued use, yet this is currently being conducted by the blm on the free roaming wild horses of the west. It is an unacceptable, unsustainable, lousy herd control resolution. There is not enough activists/advocates to study the free roaming horses that would be vaccinated to avoid sterilization. Wildlife ecologist, Craig Downer has proposed a natural, holistic “Reserve Design” as an alternative in the management of wild horses which could work, and would protect the genetic viability of the wild horse herds in the west. Set the greed aside BLM, and do what’s best for the American mustangs and the American people.

I’m was so glad the media picked up the story of being throw out of a public meeting. The media can do good. Like now. The more people become aware the more they get involved. Wild horses & burros have been on our land long before we were. They took care of the land & their herd in their own natural way. Leave these beautiful animals alone before they become a distant memory.

It is a primitive “solution” at best and unfortunately Advocates and others have chosen it much too quickly instead of standing together and implementing Reserve Design and encouraging Holistic Ranching. Along with the notion that Horses and Burros currently overpopulate the land, there is of course, another “Spin” by BLM and cronies, that Wild Horses and Burros degrade the Range. Certainly, we should all know by now, habitats are primarily degraded by Cattle and Sheep. The Wild Horse is indigenous to America (A Returned Native) while Cattle are not. Cattle and Sheep are the animals that need to be managed. Until Livestock destruction to the range and Public lands are discussed seriously, Advocates cannot be expected to
    support PZP, BLM Population “theory” or Horses as destructive to the Ecology of North America, an environment they acclimated to millions of years ago. Why it is that people choose to believe the lies of a dysfunctional Government Agency, is beyond me. Perhaps people find it difficult to question “Authority” even when it’s destructive and obsolete.

  30. This is a classic ploy to instill fear and control. Animal cruelty is just the tip. Americans have once again been miss lead by the powers that be and that our elected officials chose to do nothing, is a rampant tactic that continues to over ride what the public wants for their land use. Our national heritage continues to be systematically destroyed for one plain and simple reason; wild horses do not provide an income to the very few corporate livestock ranch owners and their cronies. There is plenty of land for us all but there are those who want it for just themselves and their interests due to their own fear and poor judgement. This is a case of greed and power…Are we not all fed up with this theme? Make a difference and call your local congress person now!!!

  31. So many wild horses have already been lost, in holding pens or murdered-slaughtered. It is time to raise up an army for those who remain as the out of control methods of a BLM gone mad has to stop. We have been entrusted the care of the land and all our relations—the four legged the winged the crawlers—we must find a way back to honoring their journey as if our own. Warriors stand up now and take no more!

They lied time and time again, they have been found out in those lies, they have been found out in the illegal activity, they have been found out for being weak and living for greed and power, We need to stand against all plans than any of these gov or rancher idiots have, Protect mustangs is doing a great stand up job and should be incharge of all thats going on
