Feral horse cull commences in the central Kimberley

An aerial cull of thousands of feral horses has started on two Indigenous pastoral leases in the central Kimberley.

The Kimberley Rangeland Biosecurity Group says there are about 6,000 feral horses on Lake Gregory and Billiluna stations. However, the Pastoralists and Graziers Association believes the number is closer to 9,000.

The Aboriginal Lands Trust says the horses must be removed to protect the local environment, to comply with legal obligations and to mitigate animal welfare and public health issues.

The RSPCA is also supporting the aerial cull.

Clinton Wolf is the chair of the Aboriginal Lands Trust.

“What I am firm on is the number in relation to the aerial count and that was 6,000 horses,” he said.

“The logistics is basically that the RSPCA is heavily involved, we’ve got two veterinarians there, I believe that there is two helicopters involved and that’s the standard way of doing culls in Western Australia on pastoral leases and we’ve just tried to make sure that we’ve followed to the letter the exact requirements for best practice aerial culling which we believe and we’ve been told by a variety of experts is the most humane way of dealing with the feral horse population.”

Mr Wolf says the traditional owners want the feral horse numbers under control for business and personal safety considerations.

“Build a fence one day and the next day it’s not there because a huge herd of wild horses has run right through the middle of it. You can see the distress in their eyes and they’ve had a connection with these horses for 120 years.

“When you see them say we’ve had enough and sure we want a few horses out here because we want to maintain that connection, but you can’t have six to seven thousand horses running around and what is concerning them also is when there was no water around, the horses were coming into the community.

“And you’ve got two or three year old kids walking around and we’re not saying wild horses are aggressive or anything like that, but when you’ve got a wild animal that suddenly takes flight over a vehicle going past and takes off and runs over the top of a child, is anyone going to turn around and say ‘well, we should put up with that’, because quite clearly we shouldn’t.

“We’ve got a feeling that if we get on top of the bulk of them, we’ve already had discussions with Kimberley land Council rangers who are saying that as part of their duty statement that they’re prepared to participate moving forward so that we absolutely keep a handle on this.”

The Australian Wildlife Conservancy has backed the cull of the brumbies at Lake Gregory “as long as it’s humanely conducted”.

The AWC owns more than 800,000 acres in the Kimberley, most of it former pastoral stations.

The land is being rehabilitated and cleared of feral animals to help build up numbers of endangered species.

Chief executive Atticus Fleming says the brumbies don’t belong there.

“Feral horses do have a significant impact on the environment, they are driving the decline in our wildlife, along with other feral herbivores.

“So action does need to be taken. It needs to be done humanely, but we need to remove them from the Australian environment.”

Mr Fleming says the option of rounding up and breaking in the brumbies wouldn’t be practical in the vast Kimberley.

Dear Sirs,

We request you do not roundup, remove, kill, give birth control or sterilize wild horses in Wyoming’s Checkerboard area.

We call for a moratorium on roundups in the Checkerboard and elsewhere for immediate scientific population studies lasting 10 years.

Fertility control (birth control, sterilization, etc.) must not be used before 10-year population studies.

We request an investigation into conflict of interest governing discussions and decisions for removals of the Checkerboard wild horses in Wyoming.

Federal law cannot be violated under a consent decree.

American wild horses are legally allowed to roam on the 2.3 million acres under the Free Roaming Wild Horse & Burro Act of 1971. It’s important to uphold the law.

Non-reproducing herds are not protected wild horses according to the 1971 Act as they would be harassed in order to be sterilized. Also their social structure and their natural behaviors would ruined if sterilized.

The wild horses mentioned are a national living treasure and historically significant. They benefit the ecosystem as well.

We request you:

  • Do not remove horses from or zero out the Divide Basin herd and do not kill or sterilize.
  • Do not remove horses from or zero out the Salt Wells herd and do not kill or sterilize.
  • Do not remove horses from or reduce the AML (number of wild horses) for the Adobe Town herd and do not kill or sterilize.
  • Do not remove horses from or reduce the horses at White Mountain and do not kill or sterilize.
  • Do not remove horses from or reduce the horses at Little Colorado and do not kill or sterilize.

Members of our organization have visited the herds for research, inspiration, photographic and other artistic projects and plan to do so in the future. We request you do not interfere in their work by removing wild horses.

Rounding up and removing any wild horses in the Checkerboard area or performing killings or sterilizations in the field will increase global warming due to increased motorized vehicle usage on the range as well as damage the fragile ecosystem.

Tourists, researchers and students don’t want to hear about a bunch of killed horses nor do they want to see a bunch of sterilized horses out on the Checkerboard. Sterilized horses loose their natural behaviors. The essence of their social structure–the family band–would be destroyed.

Removing American wild horse to frack the land is wrong.

Have you seen GASLAND 2? It talks about why beloved American wild horses are being removed in Wyoming! Millions of people have seen the new film on HBO and around the world. Now everyone realizes you are willing to remove the wild horses to facilitate fracking and other energy/mining interests on the Checkerboard area because of the money you receive from the extractive industry.

We look forward to hearing from you regarding our request for an immediate 10-year moratorium on roundups, trapping and removals for population studies.

The wild horses in question belong to the American people. The Bureau of Land Management has been put in charge to protect them. Please do your job.

BLM Seeks Public Comment on Public Lands Nominated for Oil and Gas Exploration and Development

Ely – The Bureau of Land Management (BLM) Ely District is asking the public to review and provide comment on parcels of public land nominated for potential oil and gas exploration and development.  The 30-day public comment period concludes Monday, July 29.

The BLM received requests to lease 216 nominated parcels of public land, totaling more than 399,000 acres.  The BLM deferred several of the nominated parcels to protect sage grouse habitat.  Other parcels were removed because of proximity to the Kirch Wildlife Management Area, the Robinson Mine Plan of Operations or the Confederated Tribes of the Goshute Reservation.  The remaining 202 parcels have been analyzed for potential impacts in the environmental assessment (EA), in accordance with the Oil & Gas Leasing Reform mandated in 2010.  Lease stipulations identified in the Ely Resource Management Plan (2008) are attached to some parcels to help protect certain resources.  The draft EA is available for public review at: https://www.blm.gov/epl-front-office/eplanning/nepa/nepa_register.do.  Select Nevada, Ely District, 2013 and DOI-BLM-NV-L000-2013-0004-EA to display the project webpage.

U.S. Bureau of Land Management Violated NEPA When Selling Oil and Gas Leases in California

CAland On April 8, a federal magistrate judge issued the first major ruling in a California fracking lawsuit, finding that the U.S. Bureau of Land Management (BLM) violated the National Environmental Policy Act (NEPA) by failing to take the necessary “hard look” at the impact of hydraulic fracturing when it sold oil and gas leases in California.

The Northern District of California court held that when BLM sold four leases in 2011 for 2,700 acres of federal land in Monterey and Fresno counties, it violated NEPA by relying on outdated environmental reviews that did not address the increased prevalence of fracking in California and nationwide. The court found that BLM’s dismissal of development scenarios involving fracking as “outside of its jurisdiction” was insufficient to provide the “hard look” at environmental consequences required by NEPA.

This decision may have far-reaching implications because BLM is responsible for leasing oil and gas resources on all federally owned lands. BLM manages approximately 248 million acres and is responsible for about 700 million acres of subsurface mineral resources in the United States – much of it concentrated in the West. In addition, some of the land covered by the challenged federal leases is located in California’s Monterey shale formation, which is estimated to hold 15.4 billion barrels, or 64 percent of the nation’s total shale oil resources.

700325593  The ruling came in response to a lawsuit brought by the Center for Biological Diversity and the Sierra Club, challenging a September 2011 decision by BLM to auction off the acres of land in southern Monterey County to oil companies. Among other claims, plaintiffs alleged that BLM failed to address the impacts to water quality and other resources that result from hydraulic fracturing. The parties also directly protested the lease sale before it was finalized, urging preparation of a full environmental impact statement that analyzes potential water, endangered species, and climate change impacts, including potential impacts from fracking wastewater. The court has asked for a joint recommendation on the proper remedy and next steps in this case by April 15. According to their press release, the Center and the Sierra Club believe the lease sale should be set aside.

This Thursday, Berkeley Law’s Center for Law, Energy & the Environment (CLEE) will release a new report on hydraulic fracturing in California, focusing on fracking wastewater and potential water impacts.  Co-authored with Michael Kiparsky of CLEE’s new Wheeler Institute for Water Law & Policy, the report addresses the technical process, regulatory framework, and potential near-term changes to fracking in the State driven by pending agency rulemakings, lawsuits, and legislation. We also provide recommendations for more stringent oversight and transparency in fracking operations.

Interior Department’s Secretary Salazar removes more than 50,000 native wild horses from public land and now Big Oil and Banking’s Sally Jewell, currently CEO for REI, will be appointed to finish the job.

Clearly we are witnessing Big Oil and the Banking Industry take over what was set aside for the people. They are zeroing out the indigenous wild horse, living in freedom, in order to industrialize and pillage public land for the extractive industry.

Is the Safari Club International behind this appointment? They allegedly support removing environmental protections for hunters yet the extractive industry benefits from clearing away environmental restrictions don’t they?

Did you know the Sierra Club is buddies with the Safari Club? They both came out against wild horses and pro-roundups under Secretary Salazar’s reign. Yes, they make strange bedfellows but if you do a little research it all becomes clear . . .

Are we going to sit by and allow this to happen?

Obama to nominate CEO of outdoor equipment giant REI to become interior secretary

President Obama on Wednesday will nominate Recreational Equipment (REI) chief executive Sally Jewell to head the Interior Department, according to a White House official who asked not to be identified because the public announcement has not yet been made.

The choice of Jewell, who began her career as an engineer for Mobil Oil and worked as a commercial banker before heading a nearly $2 billion outdoors equipment company, represents an unconventional choice for a post usually reserved for career politicians from the West.

But while she boasts less public policy experience than other candidates who had been under consideration, Jewell, who will have to be confirmed by the Senate, has earned national recognition for her management skills and support for outdoor recreation and habitat conservation.

In 2011 Jewell introduced Obama at the White House conference on “America’s Great Outdoor Initiative,” noting that the $289 billion outdoor-recreation industry supports 6.5 million jobs.

Jewell, who is being nominated to succeed Interior Secretary Ken Salazar, would take over at a time when many conservationists are pressing Obama to take bolder action on land conservation. Salazar devoted much of his tenure to both promoting renewable energy on public land and managing the 2010 Gulf of Mexico oil spill.

On Tuesday former interior secretary Bruce Babbitt gave a speech at the National Press Club calling on the president to set aside one acre permanently for conservation for every acre he leases for oil and gas development.

“It’s that simple: one to one,” Babbitt said. “So far, under President Obama, industry has been winning the race as it obtains more and more land for oil and gas. Over the past four years, the industry has leased more than 6 million acres, compared with only 2.6 million acres permanently protected. In the Obama era, land conservation is again falling behind.”

Facingcongressional opposition and budget constraints during Obama’s first term, Salazar emphasized the importance of enlisting private sector, state and local support to protect major landscapes through America’s Great Outdoors Initiative. Jewell emerged as a strong advocate of the policy, and is likely to continue such efforts.

While public lands protection has traditionally enjoyed bipartisan support, this issue has become increasingly polarized, and the 112th Congress was the first one since 1966 to fail to designate a single piece of wilderness. Environmentalists such as Babbitt have urged Obama to use the Antiquities Act, which gives presidents the executive authority to set aside land as national monuments, to protect ecologically valuable areas in the West.

Jewell has pushed for land conservation both in Washington state, where she lives, as well as nationally. She is a founding board member of the Mountains to Sound Greenway Trust, which focuses on a stretch of land spanning from Puget Sound across the Cascades, and helped lay out a plan for the National Park Service as a commissioner on the “National Parks Second Century Commission.”

Wyss Foundation president Molly McUsic, whose group focuses on land conservation, wrote in an e-mail that Jewell “understands the full economic potential of America’s resources.”

“She knows the oil and gas business from having worked at Mobil and in the banking industry, but also understands the growing economic potential of America’s $646 billion outdoor recreation industry,” McUsic added. “She knows that to grow the economy, development of energy resources must be on equal ground with the protection of places that drive tourism, travel, and recreation.”

While Jewell is more closely identified with the Democratic Party than the Republicans, she made a high-profile appearance with Sen. John McCain(R-Ariz.) back in 2008 when he was running for president. McCain spoke with Jewell and others at an environmental policy roundtable outside of Seattle, during which the senator argued that he had stronger environmental credentials than either Obama or Hillary Rodham Clinton, who were both vying for the Democratic presidential nomination at the time.

Other contenders for the Cabinet position in recent weeks included former Washington governor Christine Gregoire (D), Interior Deputy Secretary David Hayes and Sen. Tom Udall (D-N.M.).

Let’s speak up before March 6 to help protect residents, workers, and the environment

The Bureau of Land Management is analyzing a mammoth, 9,000-well natural gas drilling project proposed in south-central Wyoming near Wamsutter.

Called the Continental Divide-Creston project, it would be one of the largest single natural gas field developments in the United States.

We are asking for your help to reduce the environmental impacts of this project as much as possible. Please send your comments to the BLM by March 6! (See below)

Our biggest concern—and what we are focusing on the most—is making sure this project is done right relative to air quality. This development needs to be conducted in such a way that residents and workers are safe and can breathe clean air, and that the air, land, and wildlife, stays healthy in the future.


This Proposed Project Will Be Bigger than Rhode Island

The BLM would allow BP America Production Company and other operators to drill up to 8,950 new wells. The project area would include 1.1 million acres—or more than 1,600 square miles—much of which would be in what’s known as the “railroad checkerboard.” And much of this proposed project would involve “infill” of existing natural gas fields where 4,400 wells have already been drilled.

The Wyoming Outdoor Council does not oppose development in this area outright because it is not located in one our “heritage landscapes” (iconic areas where we believe any energy development is inappropriate) and it is largely an “infill” project where there is already a lot of existing disturbance.

However, although much of this area is far from pristine, we need to do everything we can to ensure that companies “do it right” at every stage of this project’s development. Therefore, we believe the BLM should require careful, effective, environmentally protective measures as conditions to the development in order to protect residents, workers, air quality, and remaining wildlife habitats.

 


How to Make a Difference

The BLM has prepared a draft environmental analysis, called an “environmental impact statement” for this project. It considers five alternative development options but it does not specify a “preferred alternative.”

The BLM is now accepting comments on this draft analysis. The comment deadline is March 6. It would be very helpful if you could offer your input on the draft. This could help improve the project, and help ensure that we “do it right” in the face of this massive level of development.

Here are some issues you might consider raising in your comments:

  • While much of this project is in the “railroad checkerboard”—where the BLM’s ability to protect the environment is reduced because of the intervening privately owned sections of land—the project area extends into large, contiguous blocks of public land roughly 20 miles north and south of Interstate 80. You can ask the BLM to provide enhanced protection for these contiguous areas of public lands.
  • The Directional Drilling alternative is the most environmentally protective of the current alternatives, so please ask the BLM to adopt it. This alternative would be even more effective if the BLM were to set a limit on the number of well pads that can be developed.
  • Directional Drilling has become increasingly common and popular with industry with the horizontal “reach” of these wells becoming ever greater.Having multiple wells drilled from a single well pad with directional drilling to access gas resources at great distances can greatly reduce environmental impacts. You can ask the BLM to maximize the use of directional drilling, and to require the greatest “reach” possible.

Never looking through “rose colored glasses” it is obvious that we have monumental
environmental concerns both in the nation and on the planet and are in need of serious
solutions. The U.S. government has all the abilities to perform state-of-the-arts
environmental management and yet we continue to fail. The land management agencies
have hard-working people and they put in sincere time to perform their work. However if
the Vernal Field Office is representative, there is concern in the implementation of the
BLM mission. The Vernal Office has placed priority on the exploitation of public land
for commodities. This effort is because of a focus on development of energy; due to a
fossil fuel fixation, politics, Energy Policy Act (2005), Vernal Field Office RMP (2008),
and office managers that do not understand their purpose. A quarter of the employees of
the Vernal Office have a personal interest, academic knowledge, and intent to serve the
American public in the performance of the mission. The mission and natural resource
knowledge is their prime reason for working with the Bureau. The intent of the natural
resource professional is to wisely manage habitat and fauna of public land for our
citizens.

U.S. history has shown repeated failure in the care of the natural world. We place
exploitation of natural resources and profits from these resources ahead of wisdom. In the
past we mined, logged, grazed and exploited the natural world. Pressure on our political
officials to reverse this attitude and stop deterioration of natural systems was necessary
and resulted in excellent environmental laws. The U.S. has lost numerous species and yet
we do not act for their ethical protection and subsequently in defense of our own healthy
environment. At the Vernal Office little concern has been shown to care for sensitive
species (mountain plover, sage grouse, hookless cactus). We promote energy
development without stop and continue to measure natural resources by dollar value.

The mission of the BLM is to sustain the health, diversity and productivity of public
lands for the use and enjoyment of present and future generations. As civil servants we
are obligated to all Americans to perform the BLM mission. Yet our elected, appointed
and agency administrators ask us to focus on commodities and economics as opposed to
environmental health. Commodities and economic gains are easier to measure. We work
with our elected officials but we work for our citizens. Outside influences that lead us
away from our required service to the American citizen and the BLM mission, should be
repelled by the servant. Our service to the American people is to fulfill the mission
through science, law, regulations and “team work”. Our fellow civil servants that
administer the Bureau should insist that we work together in a common goal to fulfill the
intent of the mission. Yet the Vernal Office does not work together as a professional
team, instead the office works as fragmented groups, individually following bureaucratic
requirements catering to the exploiter and political antagonist.  There is little thought for
the future by those in charge for real land health.

Health and diversity of public lands are natural entities. They do not include oil wells,
livestock, crested wheatgrass nor guzzlers. These are developments and tools to exploit
and have nothing to do with health and diversity. Productivity is not synonymous with
commodities. Protection of healthy soils, vegetation, clean air & water and a natural
fauna are the true products, which we should diligently promote before commodity
extraction. Science teaches us to not act until we know that harm will not occur to the
natural system. Whereas development asks for proof of damage to the natural system
before you restrict. The natural environment and subsequently the human environment
will be injured seriously if balance is not restored. U.S. federal land management
agencies have it in their power to be the best land stewards anywhere in the world. We
fail not in ability but in our attitude, a lack of understanding, lack of futuristic thinking
and our implementation. Our actions are based on outside forces inconsistent with the
intended mission and wisdom.

The BLM employee that did not study for a career in natural science frequently works for
the Bureau for different reasons than the natural resource professional and it appears from
experience that those who work for these different reasons are unable to visualize the
intended mission. Knowing environmental health, diversity and the true customer must
be known by the team before we can fulfill our service. Without a personal interest for
the health of the land it is difficult to implement a professional understanding. If as some
have said incorrectly that “their job was to promote oil & gas” they fail in the mission
and service to the people.

Aldo Leopold had four requisites for land-health:
1. Cease throwing away its parts
2. Handle it gently
3. Recognize that its importance transcends economics
4. Don’t let too many people tinker with it.

However Vernal:
1. Lost the mountain plover; the only known population in Utah while at the same
time the species is in decline throughout its range. Little effort to prevent this loss
was implemented and is a serious mission departure.
2. Plugging and abandonment of well sites have not been a priority. Numerous oil &
gas wells have not produced for more than 15 years and yet these sites remain un-
reclaimed. Notable of these is Seep Ridge #1; Lease #U-6616 & Seep Ridge #3;
Lease #U-10178-A. Why is it that after more than 20 years of non-production
these two wells remain idle and un-reclaimed? Federal regulation for well
abandonment (Title 43 CFR 3162.3-4) requires abandonment.
3. Land reclamation after use still appears difficult to solve. What’s the problem?
The user wishes to profit from the land and the land is owned by the citizens.
Insist that the user fulfills the reclamation requirement before permitting
additional use. Our only task is to identify need and confirm success.
4. Animal Unit Months; we have grazing allotments, allotments have specified
AUM’s and grazing occurs. Yet we disturb large percentages of our allotments
located in oil & gas fields and AUMs remain the same. If you lose 30% of the
forage in a specific allotment it is logical to reduce the AUMs by 30%.

In the Vernal Field Office we have shown no concern for the cumulative impact of the
developed area and provide in NEPA documents little quantitative analysis. We fragment
habitat extensively in energy areas resulting in ecosystem damage not unlike that which
occurred from over grazing and other historic land exploitation. It took decades for
government to stop over grazing and move toward land health. Today scars remain from
time before the Taylor Grazing Act. We have lost the only population of mountain plover
in the state of Utah, contrary to science, ethics, and policy (BLM Manual 6480 – Special
Status Species Management). We have watched as direct and indirect impacts have
literally killed individuals of a federally listed plant species with only a token effort to
prevent future actions and not an apology for our failure. Analysis of water depletion
associated with endangered fish of the Colorado River system is accomplished through a
series of documented explanations that have no attempt to monitor the quantity of
depletion and is inconsistent with critical habitat for the species. The air within the
Uintah Basin continues to be fouled in our effort to maximize energy and economic gain.
Climate change receives but token language in our NEPA documents. Socio-economics
are measured on dollar values gained without analysis showing measurement of
“degradation/benefit” to the community. Air quality causes respiratory ailments, traffic
within the community is industrial and large sums of money leave the community to
outside corporations. A myriad of other community related issues are in need of detailed
analysis.

We need to alter our bureaucratic method of operation. Focus on our mission and team
implementation as professional civil servants. Work together as a unified team of
professionals to implement the science, law, and regulations for service to the American
people. Discontinue our practice of placing our budget on projects that in truth are
developments in disguise and termed mitigation. We should utilize the budget on
monitoring and over-site. The use of the public land is the burden of the user to minimize
injury and restore to its natural state.

Without serious fulfillment of the mission we continue to harm public land as it has been
harmed so frequently in our historic past. Be honest about what is happening. It is easier
to break something than to fix it, so let us stop breaking the land.
