No shade for captive wild horses as temperatures soar in Nevada, despite requests from the public and elected officials

RENO, NV (June 28, 2013)–With temperatures rising in the triple digits, Nevada photographer, Taylor James visited the national wild horse “processing” facility twice today for Protect Mustangs. She took photos and pointed her video camera over the fence. No sprinklers were seen at Palomino Valley Center (PVC). Surely there were sprinklers somewhere because the Bureau of Land Management (BLM) announced they were putting sprinklers up to appease public outcry. Why are they putting sprinklers up when the wild horses need shade?

“I witnessed wild horses at Palomino Valley who were in distress today because of the heat,” states Taylor James. “I could not see any sprinklers from my vantage point. They looked miserable without shade.”

Anne Novak, Executive Director of Protect Mustangs, has appealed directly to Secretary Jewell to intervene–to stop the suffering and create shade for the wild horses and burros at Palomino Valley Center. “What these captured wild horses need in sweltering triple digit heat is shade from the blistering sun,” says Novak.

“We have a state law that says dogs need proper shade, food and water, so why not those horses?” asks Mark Manendo, Nevada State Senator. “Why would the BLM not want to provide proper care for the horses–especially if they require adopters must prove the wild horses will have access to shade?”

Protect Mustangs is working with elected officials, advocates and concerned members of the public, to request the BLM give captive wild horses and burros shade and provide them with 24/7 onsite personnel.

Currently no one lives at the facility. No one is there daily after business hours. If there is an emergency, no one can ensure the safety of the more than 1,800 treasured wild horses and burros after normal business hours and on most weekends.

“We joined with Senator Mark Manendo on June 9th to officially request the BLM in Washington provide shade for the captured wild horses at Palomino Valley and elsewhere,” states Novak. “They have done nothing.”

“The BLM must think this sort of animal cruelty is acceptable–but it’s heinous,” adds Novak.  “How many wild horses will perish before they finally do something? Their disregard for America’s icons shows that they just don’t care.”

In the wild, native horses can migrate to more comfortable places during heat waves. In the pens they are trapped and at the mercy of those who chased them with helicopters, tore them from their families and took them from their homes on the range.

Palomino Valley Wild Horse and Burro Center Installs Sprinklers to Mitigate Effects of Heat Wave
Reno, Nev. – In expectation of continued three-digit temperatures this weekend and to address public concerns, the Bureau of Land Management’s (BLM) Palomino Valley Center outside Reno is installing sprinklers to three of the large, outside wild horse pens and five mare/foal pens as a stop-gap measure to attempt to reduce heat levels inside the corrals. BLM staff will observe how the animals respond to the sprinklers, which could include avoidance, or chewing on and rubbing against the sprinklers, which are foreign structures to the animals.
The use of shade shelters in corrals has been considered and evaluated by BLM numerous times. Current policy is based on the following principles:
– Wild horses and burros are accustomed to open environments and when their nutritional demands are met, they do well against the natural elements, including sun, rain, snow, and hot and cold temperatures.  At Palomino Valley, the animals are fed hay each day; mineral blocks are available in each pen; and a continuous supply of water is available via automatic waterers.
– Open corrals with plenty of sunlight have proven to be the best way to minimize disease-causing organisms.  The BLM’s open corrals enable the drying effects of the sun and wind to take effect.  The corrals are sloped to minimize the pooling of precipitation in the pens and to allow it to channel to the exterior of the facility.
– Due to the temperament of the animals, the social hierarchy between the animals, and their unfamiliarity with shelters, the BLM feels that corrals without shelters are the safest approach.  Shelters could create a potential obstacle for animals running and playing in the corrals, and cause significant injuries. The BLM has wind breaks and/or shelters for sick animals.  The “sick pens” do not have the same safety issues because the animals are in a smaller area with limited pressure from other animals.
Weather conditions, as well as determining the most appropriate way to address the needs of the animals, vary across the country.  What works well and is needed for a small facility in the Midwest may not be necessary or work well for a large facility in Southern California or Nevada.  Each facility uses methods compatible with local animal husbandry practices to provide the best solution for maintaining the large numbers of animals for which the BLM provides care. Nonetheless, plans are underway for the BLM to consult the scientific research community to inform future options on this issue.
The Palomino Valley Center, located about 20 miles north of Reno, is the largest BLM preparation and adoption facility in the country with a capacity of 1,850 animals.  It serves as the primary preparation center for wild horses and burros gathered from the public lands in Nevada and nearby states.  Visitors wishing to adopt are encouraged to call the Center prior to arrival at (775) 475-2222. Public hours for visiting are held Monday through Friday from 8 a.m.-4 p.m. and on the first Saturday of each month from 8 a.m.-noon.

BLM Seeks Public Comment on Public Lands Nominated for Oil and Gas Exploration and Development

Ely – The Bureau of Land Management (BLM) Ely District is asking the public to review and provide comment on parcels of public land nominated for potential oil and gas exploration and development.  The 30-day public comment period concludes Monday, July 29.

The BLM received requests to lease 216 nominated parcels of public land, totaling more than 399,000 acres.  The BLM deferred several of the nominated parcels to protect sage grouse habitat.  Other parcels were removed because of proximity to the Kirch Wildlife Management Area, the Robinson Mine Plan of Operations or the Confederated Tribes of the Goshute Reservation.  The remaining 202 parcels have been analyzed for potential impacts in the environmental assessment (EA), in accordance with the Oil & Gas Leasing Reform mandated in 2010.  Lease stipulations identified in the Ely Resource Management Plan (2008) are attached to some parcels to help protect certain resources.  The draft EA is available for public review at: https://www.blm.gov/epl-front-office/eplanning/nepa/nepa_register.do.  Select Nevada, Ely District, 2013 and DOI-BLM-NV-L000-2013-0004-EA to display the project webpage.

You do not need to live in the U.S.A. to comment as we know Wyoming tourism draws people to the state from around the world to see native wild horses.

The Bureau of Land Management (BLM) released an Environmental Assessment (EA) for the roundup and removal of wild horses from the “Checkerboard” region HMAs–Adobe Town and Salt Wells Creek (ATSW) in the Red Desert of Wyoming. The EA reads:

“All wild horses on private lands and on the checkerboard lands within the ATSW Complex would be removed in accordance with the 2013 Consent Decree.”

Since wild horses move freely from public land to private land in the “Checkerboard” region, will they chase the native wild horses with helicopters on to private land to remove as many as possible from the entire public-private land region? They have chased them on to public land in the past to trap them.

Does this roundup have a back-room connection to BP America’s Continental Divide – Creston (CD-C) natural gas project that will frack 8,950 new gas wells? The massive CD-C project already has 4,400 existing oil and gas wells.

Focus on the environmental damage because of the proposed Adobe Town Salt Wells Roundup. Oppose the roundup and request Alternative C, No Action Alternative, No removal. You can make it short. The point is to make a comment because they count how many come in. Below are some talking points:

  • Damaged and trampled plants, terrain and destruction of the fragile ecosystem from chasing wild horses with helicopters and the potential for a stampede.
  • Damaged and trampled plants, terrain and destruction of the fragile ecosystem from trucks and trailers as well as equipment trucks driving in and out.
  • Damage to riparian areas from chasing wild horses with helicopters and the potential for a stampede.
  • Damage to riparian areas and the surrounding fragile ecosystem from trucks and trailers as well as equipment trucks driving in and out.
  • Noise pollution from noisy helicopters assaults all wildlife and disturbs sage grouse.
  • Helicopters pollute the environment. They release CO2 that increases global warming and should not be allowed.
  • Fuel emissions from trucks carrying equipment and trailers for the roundup pollute. Trucks release CO2 that increases global warming and should not be allowed.
  • Dust from chasing wild horses, coupled with the stress, causes upper respiratory infections, possible permanent damage or possible death of native wild horses as well A hurting other animals in the ecosystem.
  • Dust from equipment trucks and trucks hauling captured wild horses in trailers causes possible damage to other species in the ecosystem.
  • Wild horses are a return-native species (E. caballus) and should not be removed. They are an essential piece in the native ecosystem, creating diversity and helping to reverse desertification. If native wild horses are removed the ecosystem will become more out of balance as we see happening because many predators species are being removed or killed.
  • Without proving overpopulation, this proposed roundup is in violation of NEPA.
  • Without proving overpopulation, this proposed roundup does not merit the use of risky chemical fertility control (PZP, SpayVac®) or fertility control made from pig ovaries (PZP-22, ZonaStat-H) as most pigs have become GMO animals and the risks are unknown. The “birth-control” was approved by the EPA as a “restricted use pesticide” only.
  • Without proving overpopulation, this roundup should be cancelled. Even the NAS study said the BLM fails to provide accurate data to support their overpopulation claims.
  • Native wild horses are not “pests” and should not be labelled or treated as if they are. They are an essential part of the native ecosystem.

“PZP and other fertility control should not be used on non-viable herds either. Most of the remaining herds of wild horses are non-viable. Adobe Town/Salt Wells Creek Wild Horse Gather EA Available

The Bureau of Land Management (BLM) Rawlins and Rock Springs field offices are launching a 30-day public comment period on an environmental assessment (EA) to gather excess wild horses from the Adobe Town and Salt Wells Creek (ATSW) Herd Management Areas (HMAs).The two HMAs are managed collectively as the ATSW Complex due to wild horse movement between the two areas. The Complex is located in the checkerboard pattern of mixed public, private, and state land ownership in Sweetwater and Carbon counties, stretching from Interstate 80 south to the Wyoming/Colorado border. The BLM respects private land owner rights while managing wild horse populations. The ATSW Complex includes approximately 510,308 acres which are privately held. This gather would reduce landowner conflicts where the wild horses stray onto private lands.Population surveys conducted in May 2012 found approximately 1,005 wild horses in the ATSW Complex. However, wild horse populations are expected to increase by approximately 20 percent with the 2012 and 2013 foaling seasons, bringing the population in the ATSW Complex to an estimated 1,447 wild horses by summer.The appropriate management level (AML) for the ATSW Complex is 861-1,165 wild horses. The gather is necessary to maintain the wild horse herds toward the lower range of the established AMLs in compliance with the 1971 Wild Free-Roaming Horse and Burro Act, and the 2003 Wyoming Consent Decree. The AML for the ATSW Complex was established through an agreement with private land owners and wild horse advocacy groups. It was confirmed in the 1997 Green River Resource Management Plan (RMP) and through the 2008 Approved Rawlins RMP. The proposed gather is anticipated in 2013.

The proposed action in the EA is also in conformance with the Consent Decree with the Rock Springs Grazing Association (RSGA) ordered by the U.S. District Court on April 3, 2013, to remove all wild horses from private lands within the checkerboard portion of the ATSW Complex in 2013. According to the Consent Decree, if the numbers are likely to exceed 200 wild horses within the checkerboard portion of the ATSW Complex, the BLM shall prepare to remove the wild horses from the private lands.

The ATSW Complex was last gathered in fall 2010. During that gather, 99 mares released back to the HMAs were administered the PZP fertility control vaccine. Fertility control is an alternative being considered in the EA.

The BLM manages more than 245 million acres of public land, the most of any Federal agency. Bogus Science and Profiteering Stampeding Their Way into Wild Horse Country

A Review of Using Science to Improve the BLM Wild Horse and Burro Program: A Way Forward (2013)

I’ve reviewed the entire 300+ page National Academy of Sciences report—clearly a major undertaking by all the scientists involved and a bit of a “heavy” read—including its academic findings and recommendations (“A Way Forward”) which are, in the end, woefully predictable. Thinking about it, however, the scientists who created the report really had no choice, given the limits of the Wild, Free-roaming and Burro Act itself, if we are to accept that, but to work within its boundaries and the conundrum set upon them by that law’s specious political and land management premise and somehow respond to the task put upon them by the BLM. Clearer and more honest minds might have said, “I want no part of such a nasty, skewed project.” I also gleaned the biographies of each scientist to see what kind of understanding they would bring to the table regarding horse care based on their education and training, and if they seem like “clear minded” thinkers who could think outside the box in the best interest of any horse. On that note alone, wild horses are in trouble.

Because the “limits” put upon the NAS committee by the wild horse law are what they are, and because these are basically mainstream scientists drawn out of academia, it is entirely logical that they would recommend regulating wild horse and burro populations, in their words, “with science”. But what kind of science, one might ask? Well, the fact is, it’s the same brand of science, and scien- tific minds in today’s academia, that has failed the domesticated horse. We’re talking about scientists who serve the special interests of government and its lobbyists, the agricultural and pharmaceutical industries, and so forth, that have given us drugs and feeds and management practices that cause laminitis and other metabolic breakdowns of the horse. Indeed, it is all profitable for the very community that has created this “science based” disaster for horses. I’m not just spewing words here without foundation, horses truly suffer for it, and it is this bad science and corresponding harmful equine management practices that have given birth to and fueled the internationally burgeoning NHC movement. That is a fact—and it is a fact also that these scientists, and the special interests that fund them, refuse to acknowledge NHC because what we do and advocate for gets directly to the bottom of ethics and profiteering and inbred academic close-mindedness.

The authors of this NAS report have very skillfully woven together what is genuinely good sci- ence with the bad, while ignoring other good science altogether—all to the end of supporting the bogus proposition that their brand of “science” favors a lasting solution for wild horse management. If one reads their report carefully, however, one can sense the palpable excitement and impatience behind their drug-based recommendations. For example, they urge the BLM to step up an accurate numbers count in the HMAs (which, arguably, given that agency’s past, can never be trusted) because, they suggest, the quantities of PZP and other pharmaceutical agents needed to cleanse wild horse country will surely be vastly greater than what was used in their scientifically con- taminated control study done to the Assateague ponies of the U.S. east coast (cited in their re- port). Assateague was not good science, anymore than what has happened to those horses long before the government’s study. It catered to the drug industry and the same eugenics science that the U.S. and British governments sanctioned and used against people during the greater part of the 20th century (up to the 1960s and 70s), and that was astutely “borrowed” from by Nazi Germany for its extermination campaigns to “rid the world of undesirables”.

Just as tactfully, and just as predictably, the NAS authors stated that predation behavior was not viable, ignoring Drs. Turner and Morrow’s mountain lion predations studies referenced in my books, The Natural Horse and Paddock Paradise, and which proved the viability of natural predation on wild horse herds. Of course, the reason that natural mountain lion and wolf predation won’t work, and which the NAS report fails to explain, is because BLM management practices have provided for their extermination and/or removal under welfare ranching pressure that deflects the truth of what’s happening within their grandfathered land leases born of the Taylor Grazing Act and the BLM’s inception.

I could easily go on, and on, and on, nit picking the massive tangled NAS report, but would just be wasting my time and yours with the report’s self-serving “word salad”. The fact is, there is no genuine solution in their report that respects the natural integrity of America’s wild, free- roaming horses. And there is no debating the authors of the report either, for they are completely sold out to the very special interests who have never seen value in our wild horses. In fact, it is the science community that has recently aided and abetted the government in reclassifying wild horses legally as “pests” so that the pesticide PZP can be used on them for birth control purposes. You see, the NAS report is no surprise, as its convoluted “commandments” have been systematically orchestrated and colluded with by just about everyone in sight, including—and I am sad to say—nearly every purported “wild horse protection” group and sanctuary in the United States. Many of these groups stand to “gain” from this collusion, including the HSUS that co-owns patent rights to PZP.

Tax payers can expect to pay more, not less, as they watch their wild horse herds deteriorate genetically under the government’s Nazification of the HMAs through racism-based eugenics. This is because there is profit motive at its foundation. In fact, the report cautions that “public confidence” and trust will be an important part of the “master solution”. Inundating tax payers with scientific “word salad” that few can understand, is understood. Clearly, the public does not understand the underlying issues, except what they hear in the news. From that vantage point, this does not bode well for our wild horses.

What is needed is a new vision and a new law for genuine wild horse preservation. The current law is bankrupt and offers no real protection, let alone preservation. Science, industry and the big government have joined claws and are at war with Natural Selection, because they are losing—and they know it. And, it is for this reason, that Science is now being called upon to step up the delusion that the war on nature can and will be won. Like the war on cancer, no such victory is forthcoming. But because the war is profit driven, the war is welcome. Read the NAS report with a critical eye, and you will see this. In the end, HMAs will become zoos with GMO wild horses. Like those we see in the wild horse protectionist’s “sanctuaries”: sad, pathetic parodies of real wild horses. Is this what the public envisioned when it stood behind the original wild horse protection law? Of course not. but, here today, government and science and industry (and its camp following ersatz wild horse protectionists begging for crumbs), all hand in hand, are going to exploit wild horses and unwitting taxpayers for what they can—until, at long last, nature has proven them wrong, and the deceptive game is exposed for all to see. The Assateague model, which they will cite and hold up, is a broken one. But they are counting on an uninformed public to buy into it. Those of us in the NHC movement know better and can refute it with facts by simply looking at the hooves of those horses, if not the non-adaptative environment they are squeezed into be- cause of an historical fluke. Looking through the bios of the NAS committee members, I seriously doubt that any of them would have a clue of what I’m talking about.

The Obama Administration, as much of the voting public on both sides of the aisle have come to realize, is a compromised, “sold out to big industry” travesty that is going to stand be- hind the eugenics science and land grab scheme fully intended to bilk the taxpayer and pad the pockets of profiteers who, quite frankly, don’t give a damn about wild horses. That includes Sally Jewell, Obama’s hand-picked clone of Ken Salazar to head the Department of the Interior (BLM’s overseer), who is no friend of the wild horse or any horse. She came right out of big banking and the oil industry. Check out her bio on her DOI government website. She will go right along with “big science” because that is where the money is and because, the fact is (and it is not rocket science to figure it out), it will lead to the decimation of wild horse herds. James Kleinert’s film “Wild Horses and Renegades” draws a direct line between Jewell, “wild horse pests” and their extermination, and the land grab now going on in BLM country by big industries such as BP and backed by the Obama Administration.

Critique of BLM’s Broken Wild Horse & Burro Program

To their credit, the NAS critique of BLM totally discredits the BLM’s unscientific management methodology, particularly re: gauging population levels.  Unfortunately, they prescribe a primarily pharmaceutical remedy for a problem that hasn’t been established yet, i.e. ‘over-population’. How can you assert that there is overpopulation of wild horses and/or burros when you:

1. Don’t know what the population of horses or burros currently is, in a given HMA

2. Have no data-driven basis for gauging how many horses or burros a particular HMA can support. In practice BLM treats all habitats as being pretty much the same, and as resource poor, by requiring 1000+ acres/ horse or burro.

The NAS report also buys into BLM’s myth that wild horse & burro populations are increasing at a fairly constant rate of 15-20%/ year regardless of some radical differences in range quality between one HMA and another….

as well as radical differences in the structure, health and genetic viability of one herd vs. the next.

3. Fail to address the impacts of cattle and sheep upon rangelands, and upon wild horse reproductive success and recruitment rates

What I most appreciate about the NAS report is that they confirm key criticisms made by advocates, and ignored by the BLM, for a very long time including:

1.  the BLM’s population numbers are speculative at best, and fictitious at worst !

2.  the roundups are a counter-productive and inhumane solution to a problem (overpopulation) which may or may not exist in a given locale, at a given time.

3. the frequent and aggressive regime of roundups actually stimulates increased reproduction, migration and over-population, at -least where enough equines survive the roundups or can migrate from adjacent herd areas. This creates a vicious cycle wherein aggressive roundups create a need for more frequent and aggressive roundups.

Glaring omissions in the NAS report include:

1. The question of what constitutes “fair and balanced” apportionment of forage and water between horses and livestock on a given HMA, -which is critical to ascertaining whether the range is being overgrazed, how much, and by what animals. Without exception, livestock are allocated the lion’s share of available forage, typically upwards of 80%, -where data is even available.

2. what to do with the 37-50,000 horses and burros now languishing in long and short term holding. including what proportion should be returned to their rightful range, on what schedule…. etc. Until this ‘overpopulation problem’ is addressed, there will continue to be a wild horse ‘population crisis’ and a costly one at that.

3. How to induce an agency accustomed to being regarded by the world at large as the default authority on public rangeland capacity and on wild horse and burro population levels residing on them, to begin managing both on the basis of actual, current data rather than on data, or fudged numbers, of varying age and veracity and hence with questionable credibility.

Overall, though, the NAS panel indicted a sadly flawed, broken program in desperate need of a total makeover, starting with a basic need for fresh data and a scientific approach vs. the “Trust us because we’re the authorities on public lands and the wild equines that live there” which has prevailed for 40+ years that BLM has been tasked with managing this priceless heritage for all of US.

We are grateful that the National Academy of Science (NAS) recommends stopping cruel roundups  but we challenge their decision to control alleged overpopulation like a domestic herd with humans deciding who survives and breeds.

NAS deploys the BLM overpopulation myth to push EPA restricted use PESTICIDES (Immunoconraceptive PZP & GonaCon®) as well as sterilization on Native #WildHorses.

This is part of the plan named after Ken Salazar, the previous Secretary of Interior, whose mission was to wipe wild horses off public land, stockpile them at taxpayer expense and send many into the alleged slaughter pipeline.

The Salazar Plan began in 2009 -10, despite public outrage. Its focus was to remove wild horses and burros to facilitate the energy and water grab on public land.

The renewables market abroad is hot. Fracking and exporting natural gas through pipelines across the West is causing environmental damage. Wild horses would require mitigation so they lobbied for the BLM to get rid of them.

The Salazar Plan feigns an overpopulation crisis to remove most native wild horses from their legally designated ranges and stockpile them in government holding. They are torn from their homes, families and at risk of being sold to probable slaughter.

Overpopulation is a MYTH used to ruin native wild horses. There are maybe 18,000 wild horses left on more than 31.6 million acres of public land designated for their use. They are reproducing at a higher rate because nature knows they face extinction from the gluttony of roundups since 2009. Immunocontraceptives are risky. Sterilizing them is wrong. Put the 50,000 in holding back on the range so they can fill their niche in the ecosystem.

We are witnessing the final attack on the indigenous horse and it must be halted.

Man-made fertility control will domesticate wild horses and wipe them out. Survival of the fittest is Mother Nature’s way to select who breeds to protect the herd.

Domestic horses are manipulated by man. Their weaknesses are evident as a result.

We ask the NAS, the BLM and certain members of the advocate community, “Do you really think man can choose who breeds better than nature? Do you realize that by supporting chemical fertility control many will be sterilized and loose their place in the herd?”  What happens when they all die off?  Will you then realize they were never overpopulated?”

The National Academy of Science’s findings clearly state that the Bureau of Land Management (BLM) has failed to provide accurate estimates of the nation’s population of wild horses and burros. Therefore, the NAS cannot conclude that a state of over-population exists and or provide a recommendation for artificial management considerations such as “rigorous fertility controls” to control populations for which the complex population dynamics are currently unknown. However, the NAS is recommending science-based methods to improve current management practices, population estimates, and the overall health of the ecosystem which could provide key information toward sustainable and effective management that could prevent the removal of wild horses and burros from our public lands.

BLM plans to use “aggressive birth control” to prevent the expansion of the wild horse/burro populations that remain. Chief among the drugs to be used is PZP (porcine zona pellucida). This injected drug covers the eggs, or ova, of mares, preventing sperm from fertilizing them. It is experimental, however, and has some questionable effects upon the horses themselves, both individually and collectively. For example, its effect leads to mares’ repeatedly recycling into estrous, thus stimulating stallions to repeatedly mount the treated mares — all to no avail. This frustrating situation causes much stress among individuals of both sexes and a general disruption of the social order, both within bands and, as a consequence, within the herds themselves.

Other unintended consequences of PZP are out-of-season births occurring after PZP’s effect has worn off after a year or two.  These births have been observed during the colder late autumn and winter seasons (e.g. Pryor Mountains her by G. Kathrens) and their un-timeliness causes suffering and death among both foals and their mothers.

PZP and other fertility control should NOT be used on non-viable herds.   Most of the remaining herds of wild horses are non-viable.  The NAS and any advocacy groups that are pushing PZP and other fertility control have not carefully studied all of the caveats in Dr. Gus Cothran’s genetic analysis reports along with the remaining population of each herd of wild horses.

1. Wild horse mares that are darted with PZP can become permanently sterile, making the viability of the herd impossible as the older mares die, there are no mares to have foals.

2.  If the Lead Mares are darted with PZP, they can become sterile, making the family herd disorganized; the stallion does not understand why she won’t foal; and she may leave the family herd she knows because of the disorientated. This has happened with older mares as they are not able to foal and they are the lead mares, leaving no mare to teach them where to graze, find minerals, water, or when to do certain things that wild horse herd families do.

3.  The mares who are pregnant after they have been darted with PZP can and do foal out of season. This means that they can not keep enough milk for the foal; and the winter weather is too harsh for the foal to survive. Prognosis: death.

4.  Considering the consequences stated above, this is too risky a business to lay at the feet of an already depleted wild horse herd. It must be taken into consideration that PZP is just as dangerous as a mountain lion, it is permanent, and it is deadly.

To its credit the extensive review of the BLM’s failed Wild Horse & Burro Program criticized the agency for relying primarily on aggressive culling of wild herds primarily via helicopter roundups which “perpetuate the overpopulation problem by maintaining the number of animals at levels below the carrying capacity of the land, protecting the rangeland and the horse population in the short term but resulting in continually high population growth and exacerbating the long-term problem” the National Academy of Sciences” declared in a preliminary press release.  What they’re referring to is the principle of compensatory reproduction by heavily-stressed wildlife populations needing to rebound from population declines due to many factors.

Unfortunately, they quickly recommend a different intervention as a better solution without considering the ‘ do nothing”  or ‘placebo’ option which is an integral component of every credible field trial for pharmaceutical and other ‘treatment plans. Had they searched for examples of herds which have undergone minimal or no culling in the past decade or so, they would have found multiple examples of herds which appear to have achieved homeostasis (equilibrium) or something approaching it, naturally, i.e. without BLM-sponsored roundups or fertility treatments.

At least two mustang herds I’ve observed and filmed in Nevada and Arizona over the past 5-7 years meet those criteria, and some burro herds as well. The important point to remember, is that all of those herds cost the taxpayer virtually zilch to maintain in the wild. This contrasts with the cash-intensive hands-on management strategy revolving around helicopter roundups, warehousing of captured animals for life in long term and short term corrals and feedlots, as well as the fertility treatments, -the least costly and disruptive of these predominant management methodologies.

The bottom line is that sometimes we can do more, and do better, by doing less, or by letting Mother Nature do what she does best: sow and weed.

Hopefully, this option is explored somewhere in the freshly released report, and will be actively considered by the new hierarchy at BLM and the Dept. of Interior, and with much more intensive collaboration with wild equine afiscionados  committed to the survival of these herds in the wild as intended by the Free Ranging Wild Horse & Burro Act of 1971.

“Whether wild horses are sterilized or chemically “contraceptized”, at stake are the forces of natural selection being usurped by what will be tantamount to a program of “domestication eugenics” — humans determining who gets to breed and who doesn’t in wild horse country. If that door is opened, we will have turned drug companies and profiteers loose on our wild horses. We now know with certainty that such veterinary/medical interventions cause laminitis, colic, and other types of metabolic breakdown and disease. More drugs will then be needed. Thus, more profits will be pocketed. A brutal cycle is unleashed that causes harm to any horse, wild or domesticated.

“…What we are talking about here is the de facto domestication and subsequent contamination and destruction of America’s wild, free-roaming horses. It is bad enough what we’re also doing to another 51,000 who are captured, and stand idly by at tax payers expense in government holding corrals and private “preserves”? Support the misguided’s push to turn wild horses into pathological parodies of their personal horses? No thanks!

“The AANHCP offers another vision for genuine wild horse preservation that clear thinking people should be able to understand. This vision will do all things that eugenics can never do. And humanely so without compromising natural selection or burdening the tax payer. PZP is a pathogen derived immunocontraceptive vaccine, it SHOULD be intended for use ONLY in captive animals. PZP stands for Porcine Zona Pellucida. This, and other immunocontraceptive vaccines are derived from pathogenic bacterias. PZP contains Mycobacterium tuberculosis, the organism that causes tuberculosis in humans and many species of livestock, including cattle. The bacterial component of the vaccine is supposed to be a killed form, but due to the potential for bad lots causing live tuberculosis to be transmitted to humans and animals, and due to concern over the possibility of contaminating the food web, PZP would have been unlikely to recieve approval by the FDA. Instead, the EPA approved PZP as a pesticide, leaving public health professionals in ignorance of the biological nature of this vaccine. It remains unclear whether the restrictions for use allow for any PZP treated animals to be released into the wild. While such a release could pose an ongoing threat to public health for both humans and animals, the effectiveness of PZP as an immunocontraceptive vaccine is negated by only 10% immigration or emmigration into treated herds, according to a study conducted by Texas Parks and Wildlife with captive, white tail deer.

A recent clinical study in cats treated with PZP found a high percentage of injection site abscesses. Rumours of abscesses occurring in horses treated with PZP by the BLM has raised the spectre of possible bad lots of vaccine already having been used. Human exposure to tuberculosis could possibly be a concern and it is recommended that all BLM agents and equine advocates who have come in contact with the vaccine, or with treated animals, be tested for tuberculosis, to ensure the bio-security of the public.

We can not depend on ‘estimates’ of on-the-range populations or the accuracy of ‘reports’ of nearly 50,000 in captivity; neither history nor biology support the Bureau’s claims. There is a supposition that wild equine advocates have no notion of the enormity of wild or captive wild populations due to a ‘sympathetic’ response, but we can only base our data on the information we’re given, and the knowledge we already possess. For example:

Absence of any data indicating mortality, either on-the-range or in holding.

Denial of ‘reciprocal’ breeding, that is, the animal’s biological imperative to replace what’s been taken.

Absence of knowledge of specific herds and their behaviors, key factors in determining accuracy of foaling rates, which often fall far below the National average of 20%.

On-the-range herd management must be as accurate as possible, visually documented for Public use and managed through science and study. How can effective management occur if the basis of all aspects is ‘estimate’?

Concern mounts over hidden death count

We learned today that the BLM’s public affairs officer (think public relations expert) eventually responded, on April 18th, to our inquiries from April 12, 2013, wherein we requested to know the number of dead wild horses at the Nevada short-term facility since January 1st. 

The Acting Facility Manager refused to give us a simple death count. He told us we must file a Freedom of Information Act (FOIA) request to know the number of dead wild horses at the facility from January 1, 2013 to April 12, 2013 . This appeared to be a blatant lack of government transparency.

We saw the public affairs’ officer’s email for the first time this afternoon. It was unopened and was lost amongst emails. We don’t understand why the BLM did not respond back to our last email to let us know they had eventually answered our question. Emails can go unseen unlike certified letters.

We are very concerned the BLM facilities are not keeping an accurate death count related to roundups and holding facilities. The BLM admits they are not including the unbranded foals, aborted fetuses, animals born dead nor dead newborns in their count. One must ask, “How many are really dying in holding facilities after roundups?

Sorry for the delay in responding to your question. As Acting Facility Manager at the Palomino Valley Center (PVC), Jeb sought advice on your question as to what constituted a FOIA request and was originally told that it met those qualifications. Upon further evaluation, we realized it does not and apologize for the miscommunication.  Jeb is off for the next couple of days, and we wanted to get back to you as soon as possible, so I am writing to you on his behalf.

To answer your question: How many horses have died at the facility since Jan 1, 2013?  According to the Wild Horse and Burro Program System, the number of horses that have died at PVC from Jan. 1, 2013 through April 1, 2013, is 37. This number does not include stillbirths (aborted fetuses, animals born dead and newborn animals found dead) and young foals that died before they were freeze marked. Foals are freeze marked when they are weaned. This varies with the size and condition of the foals and the mares, but usually occurs sometime between three and six months of age.

Additionally, the National Wild Horse and Burro Program is currently reviewing its reporting procedures for modification.

Dear Mr. Sparks and To Whom It May Concern:

Montana BLM has zeroed out six of its seven original wild horse Herd Areas. The only one that still has any wild horses left is the Pryor Mountain Wild Horse Refuge, which was established prior to the 1971 Wild Free-Roaming Horses and Burros Act (WFHBA). In fact, Montana BLM has decided to zero out 82% of the original legal acreages that should have been set aside “principally” for the wild horses in the wild. This is a greater percentage of zeroing out than any other Western state. New Mexico comes closest at 77%. Given this initial injustice, it would seem that in the remaining area still home to wild horses, they would be treated much more fairly and given the resources and the Appropriate Management Levels (AML) that would assure their long-term viability. But such has clearly not been the case in the Pryors, where the AML range of 90 to 120 falls far short of the 250 individuals that is recommended for long-term viability in the wild by the IUCN SSC Equid Specialist Group (1992).

So I take this opportunity to thank you for sending me this scoping notice. I have reviewed this and wish to oppose the intensified use of PZP on the Pryor Mountain wild horses. They have been assigned an AML that is non-viable; and the further tampering with and inhibition of their reproduction would make them even more non-viable, especially in view of their long-term future survival, as well as their ecological adaptation to the Pryor Mountain ecosystem.

As a wildlife ecologist who appreciates these animals for the returned North American natives they are, I am particularly concerned that BLM’s repeated semi-sterilization of mares (often resulting in permanent sterilization of the mares) will cause serious social disruption. The logic is this: those mares who fail to achieve pregnancy quickly become disaffected with their band stallions and go off with other stallions in their futile attempts to achieve pregnancy. Similarly the stallions become desperate in their repeated futile attempts to impregnate the mares. This leads to widespread discontent and disruption, both within and between the wild horse bands composing the Pryor Mountain – as any – herd. This results in the serious neglect by adults of their duties to educate the younger members of their bands who are not as inhibited in their breeding as before. These immature individuals attempt to breed prematurely when the social units are in disarray. If intact they would be learning the very important lessons for survival in the demanding Pryor Mountain ecosystem, with its harsh winters, etc. As the effect of PZP wanes and some mares come back into a fertile condition, many give birth out of the normal Spring and early Summer birthing season, even in the late Fall or Winter when cold and storms cause them to greatly suffer and even die, along with their offspring. This is totally opposite the true intent of the WFHBA!

The intensified PZP approach to reducing reproduction in the Pryor Mountain wild horse herd is not the correct policy to adopt. It does not adhere to the core intent of the WFHBA. It is a major step toward domesticating these wild horses and seriously compromises their true wildness and natural adaptiveness. What I am offering in place of this “quick fix drug” approach to preserving, protecting, and managing this cherished herd (and all herds should be cherished) is a major and widely employed branch of the science of wildlife conservation known as Reserve Design. If properly and conscientiously applied, this would: (a) obviate the need to drug the Pryor Mountain mustangs by creating a naturally self-stabilizing horse population that would truly become “an integral part of the natural system of public lands” (preamble of WFHBA); and (b) “achieve and maintain a thriving natural ecological balance on the public lands” and “at the minimum feasible level” of interference by man. Both of these mandates come directly from Section 3 a of the WFHBA and should be adhered to by authorities of the BLM and USFS, the two agencies charged with fulfilling the act.

To accomplish these goals, you should:
(1) Incorporate the Pryor Mountain’s natural barriers such as the steep cliffs along the eastern side of the refuge that lead down to the Bighorn River. These will limit the expansion of the herd. Where necessary they could be complemented by artificial semi-permeable barriers.

(2) Restore natural horse predators such as the puma and wolf whose effect upon the wild horses would accord with natural selection and produce a more fit and well-adapted population in the Pryor Mountains. It has been a mistake to have puma hunting season reopened in the Pryors, and this should be rescinded in collaboration with Montana’s wildlife department.

(3) Avail yourself of options provided by Section 4 and 6 of the WFHAB in order to secure truly long-term-viable habitat for a truly long-term-viable wild horse population that is not subject to inbreeding and decline. Section 4 allows private landowners whose properties lie adjacent to the Pryor Mountain wild horse refuge to maintain wild, free-roaming horses on their private lands or on land leased from the government provided they protect them from harassment and have not willfully removed or enticed them from public lands. This is an outstanding opportunity for the public to help in preserving and protecting the wild horse herds at healthy population levels, i.e. to complement federal Herd Areas (BLM) and Territories (USFS). Section 6 of the WFHBA authorizes cooperative agreement with landowners and state and local governments to better accomplish the goals of the WFHBA. This allows for providing complete and unimpeded habitat for long-term viable wild horse populations. BLM should invoke Section 6 to establish cooperative agreements with both the National Parks Service (USDI, same as BLM) re: McCullough Peak national monument (which I believe already has such an agreement) and Bighorn Canyon National Recreation Area, as well as the Custer National Forest (USDA) in order to expand available habitat for the Pryor mustangs. As concerns the Custer National Forest, the USFS officials should not be allowed to get away with the fence they have erected and that restricts the wild horses’ traditional access to summer grazing meadows. This is on the west side of East Pryor Mountain and consists of a two-mile long buck and pole fence. This area was occupied by the wild horses in 1971 and should be a recognized legal area for them, as was documented by Dr. Ron Hall who did his study of the Pryor Mountain wild horses. It is also a prime public viewing area with great scenic visits, as I recall from my visit there in June of 2003. By erecting this fence, Custer National Forest officials defied their mandate to protect and preserve wild horses under the WFHAB; this is subject of an ongoing legal suit. BLM officials must insist this fence be taken down!

(4) Once a complete viable habitat is secured with adequate forage, water, minerals, shelter, wintering and summering habitat components, etc., the Pryor Mountain wild horses should be allowed to fill their ecological niche here and to naturally self-stabilize. This they will do as ecological climax species, as species belonging to the mature ecological sere, if only given the time and the space and the requisite non-interference by man. Thus, the socially and ecologically disruptive roundups will come to a halt; and the wild horses will harmonize with all the unique and fascinating animal and plant community that is found here. Given the opportunity, the wild horses will enhance the Pryor Mountain ecosystem and people will come to appreciate the virtue of a wild-horse-containing ecosystem.
(5) Semi-permeable fences could be constructed along the refuge’s peripheries but only where necessary. Buffer zones around the Pryor Mountain wild horse refuge should be established in order to contain the wild horses and keep them out of harm’s way. Within this buffer zone, mild forms of adverse conditioning techniques could be employed to keep the horses within their refuge. Win-win cooperative agreements with local people whereby they benefit from the wild horses as through giving paid eco-tours, providing lodging and meals, participating in monitoring and protection of the horses, etc., should be stressed. These positive opportunities should be expanded in order to make Reserve Design a success.
